Shri Mohammad Aslam Khan, learned counsel for the appellants as well as Shri Arvind Kumar Jauhari, learned counsel for the respondent are present.
It is informed that the instant matter was referred for mediation and the mediation has been successful and the dispute has been amicably settled through the course of mediation and the mediation report duly signed by all the parties and their counsels available on record along with the map, has been sent by the mediation centre and is also available on record.
It is jointly submitted by learned counsels for the parties that since the matter/dispute has been settled amicably through mediation and a written settlement/agreement signed by the parties is available on record, the appeal be decided in terms of the settlement/agreement.
Perusal of the record would reveal that this Court had directed the parties to appear before the Mediation and Conciliation Centre of this Court and during the process the mediation proceedings has been successful and a report along with settlement/agreement duly signed by all the parties and their counsels has been submitted by the mediation centre of this Bench, which is available on record in original.
Since the parties have settled the dispute amicably by entering into a settlement/agreement, which is available on record, the instant second appeal is disposed of in terms of the settlement/agreement arrived at between the parties dated 29.05.2018. The settlement/agreement dated 29.05.2018 and the map enclosed therewith shall remain part of the decree.
