The case is taken up through video conferencing as the Court is working through virtual mode.

None is present for the appellant while Shri Atul Mishra, learned counsel for the respondent no.3 is present.

Earlier card notice was sent to the appellant and the same has been served on his son and in this regard on 07.01.2022 when this case was last listed, the case was adjourned in order to provide one more opportunity to the appellant and no adverse order was passed.

Perusal of the record would reveal that the instant appeal has been filed by the appellant for enhancement of compensation and since on the last date when this case was listed, nobody was present on behalf of the appellant despite service of notice on the son of the appellant, it appears that the appellant has lost interest in prosecuting the instant appeal and thus instant appeal is dismissed in non prosecution.

However, keeping in view the beneficial object of the motor vehicle accident cases, it is provided that if the appellant feels aggrieved by this order, an appropriate recall application may be moved within one month from today.
