Heard learned counsel for the petitioner and Sri S.K.Ojha, learned Standing Counsel for the State respondent.
In pith and substance, petitioner is before this Court with a request commanding the respondent no. 2 to decide the Appeal No. 41 of 2022 (Deepak @ Dau vs. State of U.P.), under Section 6 of the U. P. Control of Goondas Act, 1970.
Learned Standing Counsel very fairly that in case any such appeal is still pending for consideration and has not been disposed of, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally directing the respondent no. 2 to decide the aforementioned appeal strictly in accordance with law, as expeditiously as possible and preferably within six weeks from the date of production of a certified copy of this order before him without granting unnecessary adjournment to either of the parties.
