This application has been filed for reviewing/modifying paragraph-20 of the judgement and order dated 12.6.2020 by which while dismissing the Special Appeal Defective No.224 of 2020 (Allahabad U.P. Gramin Bank through its Chairman and 2 others vs. Sandeep Singh) the Division Bench had left open to the bank to hold a full fledged enquiry in the matter and the payment of 50% of the back wages till the date of his reinstatement was made dependent on the final outcome of the enquiry.

Shri Sumit Kakkar, learned counsel for the bank has raised an objection regarding maintainability of the review application as the same is being pressed with concealment of material fact. Even though in response to the leave accorded by this Court the disciplinary proceeding stood culminated in the order of major penalty of termination of applicant from service vide order dated 25.1.2021. The said order was also subjected to challenge in Writ A No.642 of 2022 ( Sandeep Singh vs. Aryavarta Bank and 3 others ) and finally, learned Single Judge has dismissed the writ petition on 03.2.2022 relegating the applicant to approach the appellate authority. Without disclosing aforesaid factual situation the present review/modification application is being pressed upon, which is liable to be dismissed with exemplary cost.

Once we have declined to review the judgement and order and observed to impose an exemplary cost of Rs.50,000/- on the applicant then confronted with this situation learned counsel for the applicant states that he does not incline to press the review application.

Accordingly, the writ petition is dismissed as not pressed.
