Heard learned counsel for the applicant and learned A.G.A. for the State. Perused the record.

The present petition has been filed to issue a writ, order or direction in the nature of mandamus commanding and directing the Sub Divisional Magistrate, Sadar, District Varanasi to decide Application No.Nil of 2021 (Nand Lal Yadav vs Ramesh Chandra Gupta) u/s 133 Cr.P.C., Police Station-Cantt, DistrictVaranasi within stipulated period.

It has been contended by learned counsel for the petitioner that the petitioner has moved an application u/s 133 Cr.P.C. before the Sub Divisional Magistrate, Sadar, Varanasi but no order has been passed on the same so far and the application is pending since 01.3.2021 for adjudication.

Under the circumstances, the Sub Divisional Magistrate, Sadar, Varanasi is directed to decide the aforesaid application within a period of next four months positively from the date of production of certified copy of this order, without granting unnecessary adjournment to either of the parties strictly in accordance with law, if there is no legal impediment.

With the above direction, the petition is finally disposed of.
