C.M.Application No.116331 of 2021 has been moved for modification of order dated 26.8.2021 passed by this court.
Shri Bhupendra Veer Singh, learned counsel for the respondent no.4 and Shri Vishwas Shukla, learned A.G.A. are present.
From perusal of the order dated 26.8.2021, it appears that the petitioner was directed to deposit Rs.25,000/- with the mediation and conciliation centre of this court. The said amount has not been deposited and instead application for modification of order dated 26.8.2021 has been filed.
When the case is taken up, none appears on behalf of the applicants/petitioners to press this application.
Accordingly, the application for modification is dismissed for want of prosecution.
It appears that by efÒux of time, the instant writ petition has become infructuous.
Accordingly, the present writ petition is dismissed as infructuous.
Interim order, if any, stands vacated.
However, it is open for the petitioners to move an appropriate application within two months from today, if the matter survives.
It is made clear that if any consequential
proceedings are initiated in pursuance of the impugned FIR, the parties are at liberty to take recourse to law.
