Contention is that though a First Information Report has been lodged on 11.11.2021 in Case Crime No.0178 of 2021, under Sections 147, 149, 323, 325 and 504 IPC, Police Station Sahatwar, District Ballia but investigation has not been proceeded and concluded in a fair and proper manner.
Learned A.G.A. points out that charge sheet has already been sent to the court concerned on 07.12.2021 and arrest of accused persons was otherwise not permissible as the offences complained of required punishment below seven years and the protection under section 41-A Cr.P.C. was available to the accused persons.
Since the investigation has already been concluded and charge sheet has been submitted, therefore, no further grievance survives. Writ petition is, accordingly, consigned to records.
