Heard learned counsel for the petitioner and learned A. G. A. for the State.

This writ petition has been filed with the prayer to issue a writ, order or direction in the nature of mandamus directing the respondents to close the history-sheet No. 21A which is pending and to close the surveillance operation against the petitioner under the garb of the said history-sheet.

It is submitted by learned counsel for the petitioner that the history-sheet of the petitioner comprises of four criminal cases. In the two cases, the petitioner has been acquitted and in one case has been discharged. In the fourth criminal case, further proceedings have been stayed by this Court. Reliance has been placed on the decision of a co-ordinate Bench of this Court rendered in Krishna Chandra Singh Versus State of U. P. and others reported in 2015 (11) ADJ 219 and in Mohd. Shameem Versus State of U. P. and others reported in 2015 (11) ADJ 304.

Be that, as it may. In this backdrop, it is urged that the second respondent, i. e., Superintendent of Police, Ghazipur may be directed to take a decision on the application / representation of the petitioner.

In view thereof, on consent, this writ petition is disposed of directing the second respondent, i. e., Superintendent of Police, Ghazipur to pass appropriate orders on the application / representation of the petitioner within three months from the date of production of certified copy of this order.

It is clarified that the Court has not considered the rival contentions on merits.
