The present criminal appeal has been filed against the summoning order dated 7.12.2020 passed by Special Judge, Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Kanpur Dehat, charge-sheet dated 31.8.2020, Case Crime No. 563 of 2021, under Sections 34/323/504/506 I.P.C. and Section 3(1)da and 3(1)dha of S.C./S.T. Act, 1989, P.S. Mangalpur, District Kanpur Dehat.
Learned counsel for appellants submits that he may be permitted to file a bail application which may be decided in view of law laid down by Supreme Court in "Satender Kumar Antil versus Central Bureau of Investigation and another, Special Leave to Appeal (Cri)No.5191 of 2021" to which learned A.G.A. has no objection.
Learned A.G.A. has no objection to this innocuous prayer of learned counsel for the appellants.
Accordingly, without entering into merits of the case, the present appeal is disposed of permitting the appellants to surrender before the trial court within three weeks from today and file bail application, which may be decided expeditiously by the learned trial court in view of law laid down by the Apex Court in Satender Kumar Antil (supra).
