Pursuant to the communication of the Chief Judicial Magistrate, Mathura, the Office has submitted its report dated 20.9.2022, a perusal whereof shows that the sole appellant, namely, Jwala @ Pappu has died way back 10 years. He has submitted the statements of Investigating Officer, Gram Pradhan- Rajeshwar, witnesses Shyam Singh and Kehri Singh.
This appeal was filed against the judgment and order dated 26.8.1994 passed by Ist Additional Sessions Judge, Mathura in S.T. No. 111 of 1992, whereby the appellant was convicted under Section 326 IPC and sentenced for a period of two years thereunder.
Since the sole appellant Jwala @ Pappu is reported to be dead, the appeal stands abated.
Office is directed to return the lower court record to the court concerned, immediately.
