Heard learned counsel for the applicant through video conferencing.
Vide order dated 08.12.2021, this Court had required the office to submit report in regard to issuance of notice to opposite party/contemnor.
Office report dated 21.12.2021 indicates that order dated 03.11.2020 passed in Contempt Application (Civil) No. 4169 of 2020 was sent through registered post on 12.11.2021. The order of contempt Court had provided last opportunity to opposite party to comply the order within four months.
From perusal of record, it appears that as the registered post was sent on 12.11.2021, four months' time has not elapsed and the applicant has rushed to this Court prematurely.
In view of said fact, contempt application is not maintainable at this stage and the same is hereby dismissed.
