Learned counsel for the complainant as well as A.G.A. opposed the prayer for bail. Learned counsel for the complainant has urged that in this case the applicant is the wife of co-accused Ajay and was in love affair with the deceased prior to her marriage. Later on in the connivance with her husband and other-accused persons, she committed murder the deceased by calling him from mobile phone, which was purchased in the name of Deepak Jain and used by the applicant and other coaccused, her husband. One Gaurav, at whose house the applicant parked his car, disclosed the fact that phone call was received by the deceased. Inspite of this, there is confessional statement of the applicant and other co-accused persons, which show the complicity of this applicant for committing murder of the deceased. It is also submitted that the co-accused Ajay is absconding from jail since 21.06.2021. In support of his contention that the confessional statements of the accused persons are also to be taken into consideration while considering the bail prayer, the learned counsel for the complainant has cited judgments in the case of Mahipal Vs. Rajesh Kumar alias Polia and another , reported in (2020) 2 SCC 118, Rishipal alias Rishipal Singh Solanki Vs. Amardeep and others, reported in Crl. A. 271/2021 and Vipin Kumar Vs. State of U.P. (in criminal misc. bail application no. 29246 of 2019).
