Heard learned counsel for the applicant and learned A.G.A. for the Stateopposite party.

It is submitted that the applicant has been falsely implicated in the instant case. The applicant was not named in the first information report. He was not apprehended at the spot. The name of the applicant was disclosed in the second statement of the informant. Co-accused Salman @ Patkar, who was arrested at the spot, has been granted bail by this Court in Criminal Misc. Bail Application No. 53454 of 2021 (Salman @ Patkar v. State of U.P.) vide order dated 16.02.2022. The criminal history of the applicant has been explained in Paragraph-3 of the supplementary affidavit. The applicant is in jail since 13.12.2021 and if he is released on bail, he will not misuse the said liberty.

Learned A.G.A. has opposed the prayer for bail but could not satisfactorily dispute the aforesaid submissions from the record.

Perused the first information report as well as averments made in the application.

Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, let the applicant- Ibrahim Kasai @ Raju, involved in Case Crime No. 309 of 2021, under Sections 3/5/8 of U.P. Prevention of Cow Slaughter Act, Police Station Mohammadabad, District Ghazipur be released on bail on his furnishing a personal bond and two local sureties each in the like amount to the satisfaction of Court concerned subject to the conditions that he:

shall appear on the date fixed by the trial court;

shall not tamper with the prosecution evidence; and,

¶10

shall not pressurize the prosecution witnesses.

In case of breach of any of the above conditions, the prosecution shall be at liberty to move bail cancellation application before this Court.
