Heard learned counsel for the applicant and learned A.G.A. for the State.

It is submitted that the applicant has been falsely implicated in the instant case. False recovery of diazepam has been shown from the applicant. There are no independent witnesses to the recovery. The mandatory provision of section 50, 52 and 57 of N.D.P.S has not been complied with. The criminal history of the applicant has been explained in para 6 of the affidavit. The applicant is in jail since 22.10.2021. In case the applicant is enlarged on bail he shall not misuse the liberty of bail.

Learned A.G.A. has opposed the prayer for bail but could not satisfactorily dispute the aforesaid submissions from the record.

Perused the first information report as well as the averments made in the bail application.

Considering the facts and circumstances of the case and also perusing the material on record, without expressing any opinion on the merit of the case, let the applicant Bhura @ Hubblal involved in case crime no.712 of 2021, under Section 8/22 of N.D.P.S. Act, P.S. Etmaddaula, District Agra be released on bail on his furnishing a personal bond and two local sureties each of the like amount to the satisfaction of court concerned on the following conditions that:

the applicant shall not temper with the prosecution evidence.

the applicant shall not pressurize the prosecution witness;

¶12

the applicant shall appear on each and every date fixed by the trial court.

In case of breach of any of the above conditions, the prosecution shall be at liberty to move bail cancellation application before this Court.
