The learned counsel for the applicant has drawn the attention of the court towards page no. 27 relevant extract is at page no. 28 of the bail application being the gang charge in which two cases have been shown pending against the applicant being case crime no. 79/2021 in which the applicant has been bailed out on 24.12.2021 by coordinate bench of this court in Crl. Misc. Bail Application No. 48758/2021 and so far as case crime no. 139/2019 is concerned the applicant has appended a questionnaire dated 29.01.2022 which indicates that the applicant has been wrongly implicated in the said case. He further drawn the attention of the court towards page no. 41, 45, 48, 52 and 55 of the bail application so as to contend that in case crime no. 83/2021, 134/2019, 19/2021, 90/2021 and 133/2021 the applicant has been bailed out. He further submitted that the co-accused Ajesh Kumar Singh, Arun Kumar Singh and Chandresh Kumar Yadav have already been granted bail by coordinate bench of this court in Crl. Misc. Bail application Nos. 4815/2022, 4305/2022 and 4124/2022 vide orders dated 16.02.2022, 14.02.2022 and 14.02.2022 respectively, therefore, the applicant is also entitled to be enlarged on bail on the ground of parity. He lastly submitted that the invocation of provision contained under the Gangster Act is thoroughly unjustified and he is languishing in jail since 24.12.2021.
