The learned counsel for the applicant has argued that the FIR has been lodged under the abovenoted sections against the applicant and three others with the allegation that the applicant has committed the said offence and they acted as a gang while changing the number plate of the tractors and thereafter, they used to sell the same. He further argued that the applicant has been falsely implicated in the said case. He has drawn the attention of the court towards supplementary affidavit dated 16.02.2022 so as to contend that the applicant has been bailed out in the proceedings in case crime no. 340/2019, case crime no. 326/2019, 167/2019, 292/2020, 172/2020, 131/2020, 259/2020 and 248/2020 and the necessary order are already on record. He further argued that the co-accused have been enlarged on bail by coordinate bench of this court in Crl. Misc. Bail Application Nos. 23018/2021, 23106/2021, and 25299/2021 vide orders dated 02.08.2021, 23.07.2021 and 21.09.2021 respectively, therefore, the applicant is also entitled to be enlarged on bail on the ground of parity. He lastly submitted that the applicant is in jail since 26.11.2020.
