Heard learned counsel for the accused-applicant as well as learned A.G.A. for the State and perused the record.

This bail application has been moved by the accused-applicant- Khalid for grant of bail, in Case Crime No. 225 of 2022, under Section 2/3 of Uttar Pradesh Gangsters & Anti- Social Activities (Prevention) Act, 1986, Police Station- Fatehganj East, District- Bareilly, during trial.

Learned counsel for the accused-applicant while pressing the bail application submits that the accused-applicant has falsely been implicated in the instant case as well as in two cases mentioned in the gang chart. However, in both the cases mentioned in the gang chart, the applicant has been enlarged on bail by competent Courts and copies of the bail orders are also annexed as Annexure no.3 to the affidavit in support of bail application and Annexure SA-1 to the 2nd Suppelementary affidavit. It is further submitted that apart from the cases mentioned in the gang chart, the applicant is not involved in any other criminal case and in this case he is detained in prison since 19.11.2022 and there is no apprehension that the accusedapplicant after release on bail, may flee from the process of law or may otherwise misuse the liberty.
