examination hall. On noticing suspicious activities his search was made in presence of security Guard Vipin Kumar and a blue-tooth device along with SIM Card and a pair of wireless blue- tooth ear-buds were recovered from his possession. On being asked he confessed that he was connected with his other accomplices standing out of examination center and leaking the question/ examination paper in order to help candidates in giving answer for some gratification. It is further alleged that on his identification other candidates were identified who were also having bluetooth devices with SIM cards, wireless blue- tooth earbuds. The Culprit nos. 1 to 5 (Pravesh Kumar, Ravi Kumar, Pawan Kumar, Deepak Kumar, Monu) were isolated from other candidates giving examination. It is further alleged that on enquiry culprit nos. I to 5 confessed that they were in contact with their other accomplices on the blue-tooth devices having SIM card by which they were leaking the examination question and vice versa getting answers to the same and thereafter all three blue- tooth devices with SIM cards and blue-tooth ear-buds as well as documents of the culprit nos. 1 -5 were seized by the informant. It is further alleged during second third shift of said examination culprit nos. 5-8 namely Rajat, Pramindra and Praveen Kumar (applicant) were also found inside examination venue and on search blue- tooth devices with SIM cards, blue- tooth wireless ear-buds to be used cheating leaking the question papers to their accomplices, were recovered from the possession of culprit nos. 6-8. It is further alleged that it appears that all culprits are part of some gang who in order to cheat and make illegal monetary gains by leaking the question paper at large, in connivance with each other had conspired to leak the RRC, Level -1 Examination -2022 thus report be registered and necessary action be taken against culprits. Entire allegations leveled in F.I.R., shall reveal from its true typed copy which along with its certified copy is being filed herewith and marked as Annexure No. 1 to this AfÏdavit. On the basis of said F.I.R. one criminal case as Case Crime No. 415 o 2022, for the offence punishable under Sections 420 I.P.C., Section 3/10 U.P. Public Examination Act and Section 66-D I.T. Act, go register against applicant and 7 other accused persons at Police Station Sector-58, Noida, District-Gautam Buddh Nagar, d 13.09.2022 at about 22:27 hours, vide G.D. Rapat No. 75. It is further alleged by the prosecution that prior to registration of the aforesaid first information report some devices, along with documents in the form of admit card and Aadhar Card were recovered from the possession of the arrested accused persons and thereafter information along with eight arrested accused persons as well as recovered items, reached the Police Station.
