Heard learned counsel for the accused-applicant as well as learned A.G.A. for the State and perused the record.

This bail application has been moved by the accused-applicant- Jaiveer for grant of bail, in case Crime No. 243 of 2022, under Section 420, 467, 468, 471 I.P.C., Police Station Shishgarh, District Bareilly, during trial.

Learned counsel for the applicant submits that the applicant is quite innocent and was working private job in a Jan Seva Kendra, run by one Avaneesh Kumar. It is further submitted that the owner of the Jan Seva kendra has falsely implicated the accused so that he would not have to pay the due salary of three months. It is also submitted that nothing incriminating material has been recovered from the possession of the applicant and the there is no material on record to show that the alleged forged date of birth certificate was prepared by the applicant. There is no evidence that applicant has used the forged date of birth certificate anywhere. The applicant is languishing in jail since 22.07.2022 without having any previous criminal history and he deserves to be released on bail. In case, the applicant is released on bail, he will not misuse the liberty of bail and shall cooperate with the trial.
