Heard Sri Ashish Kumar Singh, learned counsel for the applicant and Sri Sunil Kumar Tripathi, learned AGA for the State.
This is an application for bail on behalf of the applicant, Vikram, in connection with Case Crime No. 178 of 2022, under Section 326 IPC Police Station Jariya, District Hamirpur.
The submission of the learned counsel for the applicant is that he is innocent and has been falsely implicated in the present case. He has not committed any offence. It is submitted that the applicant has been assigned the role of assault to the injured Vandana by danda and the co-accused Surendra and Indrapal have been assigned the role of assault to the injured Ram Karan by axe. It is next submitted that there is no independent witness of the alleged incident. The applicant has no criminal antecedents. It is further submitted that co-accused, Surendra @ Satendra and Indrapal have been granted bail by this Court on 21.10.2022 and 01.11.2022 in Criminal Misc. Bail Application Nos. 46165 of 2022 and 46814 of 2022 respectively. The case of the applicant stands on identical footing, hence the applicant is also entitled for bail on the ground of parity. The applicant is languishing in jail since 21.07.2022. In case he is enlarged on bail, he will not misuse the liberty of bail.
