Having considered the rival submissions made by learned counsel for the parties and on perusal of the record, it is evident that the applicant is the cousin Jeth of the deceased and has been living separately at his house and has no concern whatsoever with day-to-day affairs between his cousin and his wife (now deceased). The applicant has never demanded additional dowry from the deceased nor subjected her cruelty for the non-fulfillment of the same. On the basis of general and vague allegation, instant FIR has been lodged against the entire family members of the husband of the deceased including the applicant and the applicant, being cousin Jeth of the deceased, has been falsely implicated in the present case. As per the post-mortem report, Doctor has noted that the cause of death could not be ascertained and as such, viscera was preserved. As per the viscera report, Aluminium Phosphide is said to have been found in the viscera, however, there is no mark of injury on the person of the deceased. The victim, prima facie, appears to have committed suicide, however, the applicant has no role to play in the said incident being cousin of the deceased's husband.
