Learned counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in the present crime. It is further submitted that the applicant has been implicated by the Police by showing false recovery of 100 kgs. beef along with 2 live cow calf. Nothing has been recovered from the possession of the applicant or his pointing out. No prohibited beef has been recovered from the applicant. The prohibited cow meat was planted on the applicant. There is no independent witness to the said recovery. No forensic science laboratory report which confirms that the substance allegedly recovered is prohibited meat has been produced by the prosecution. Prosecution evidence does not connect the applicant with the alleged offence. It is stated that after taking note of entire facts and circumstances of the case, co-accused, namely, Ansar, has already been enlarged on bail by this Court vide order dated 21.10.2022 passed in Criminal Misc. Bail Application No. 47256/2022. Accordingly, the applicant is also entitled for bail. It is also submitted that there is no apprehension that after being released on bail, the applicant may flee from the course of law or may, otherwise, misuse the liberty of bail and the applicant is in jail since 10.09.2022 and the possibility of conclusion of trial in near future is very bleak.
