Learned counsel for applicants contends that applicants are the mother-in-law and father-in-law of the deceased. Applicants are named as well as charge sheeted accused, but they are innocent. Allegations made in the F.I.R. with regard to additional demand of dowry are false and concocted. To buttress her submission, she submits that marriage of son of applicants was solemnized on 16.5.2019. The occurrence giving rise to present criminal proceedings has occurred on 8.8.2021. However, in the interregnum i.e. a period of two years and three months, no compliant was filed nor any criminal proceedings were initiated by the deceased or her parents against the applications. She further submits that the deceased was a short tempered lady and she has taken the extreme steps of committing suicide by hanging herself. Bona fide of the applicants is also explicit from the fact that except for the ligature mark, no other external or internal ante mortem injury was found by the Autopsy Surgeon on the body of the deceased. Referring to the material on record, it is then contended that upto this stage, there is no such material on record on the basis of which it can be definitely concluded that applicants have even abetted in the commission of alleged crime. Applicant Kamla Devi is the mother-in-law of the deceased, she is a lady. Placing reliance upon the provisions contained in proviso to Section 437 Cr. P. C. she submits that since applicant Kamla Devi is a lady aged about 62 years, she is liable to be enlarged on bail. Applicant Rajendra Singh is the father-in-law of the deceased, but he is also an old man aged about 64 years.
