Learned counsel for the applicant submits that he has been falsely implicated in the present case. Applicant is a government servant and was working as a Village Development Officer during his tenure. He submits that in pursuance of the order dated 10.12.2020, the applicant has deposited the entire amount i.e. Rs.4,28,183/- as has been alleged in the FIR. He further submits that order dated 10.12.2020 passed by District Development Officer was quashed by this Court vide order dated 17.02.2021 mentioning therein that aforesaid Authority has no jurisdiction to take action under Section 27 of the U.P. Panchayat Raj Act, 1947. Thereafter, a representation regarding refund the aforesaid amount which has been deposited by the applicant has been moved before the Authority concerned but till date no action has been taken by the Authority concerned. He further submits that during the entire service period of the applicant there is no single adverse entry against the applicant. Apart from this case, applicant does not have any criminal history. Applicant is a law abiding citizen and is languishing in jail since 28.09.2022. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail.
