Learned counsel for the applicants has submitted that the applicant is innocent person and has falsely been implicated in the present case due to ulterior motive. It is submitted that in the gang chart annexed with bail application, three criminal cases have been shown against the applicant in which the applicant has been enlarged on bail. It is further submitted that except the cases shown in the gang chart, the applicant has criminal history of four cases to his credit, out of which he has been enlarged on bail in three cases. It is further submitted that the co-accused Sonu, Katvaru, Santram @ Santa and Shrikesh @ Moosey have already been enlarged on bail by another Coordinate Bench of this Court vide orders dated 26.10.2021, 10.12.2021, 03.02.2022 and 22.03.2022, passed in Criminal Misc. Bail Applications No.33520 of 2021, 48786 of 2021, 44882 of 2021 and 55793 of 2021. Copies of the bail orders have been produced by counsel for the applicant before this Court during course of the argument. Learned counsel for the applicant has next submitted that the applicant having better case for getting bail on account of parity. There is no prospect of trial of the present case being concluded in near future due to heavy dockets. It is also submitted that there is no apprehension that after being released on bail, the applicant may flee from the course of law or may, otherwise, misuse the liberty of bail. It is further submitted that the applicant is neither a leader nor a member of any gang and he is languishing in jail since 07.09.2021 and the possibility of conclusion of trial in near future is very bleak.
