Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
By means of this application, the applicant, Sonu Yadav, who is involved in Case Crime No. 104 of 2021, under Sections 60(1)/63 of Excise Act and Section 3 of Epidemic Diseases Act and Section 420, 269, 270, 467, 468, 471 IPC, Police Station Marhara, District Etah is seeking enlargement on bail during the trial.
It has been contended by the learned counsel for the applicant that the applicant has been falsely implicated in the present case due to ulterior motive. It is further submitted that whole prosecution story is false, fabricated and concocted. It is further submitted that nothing has been recovered from the possession of the applicant. It is further submitted that the applicant was not present at the place of incident nor arrested on the spot. It is further submitted that name of the applicant has came into light in the confessional statement of co-accused Jogenra @ Jugnu and Ankit Kumar. It is further submitted that the applicant has criminal history of 10 cases to his credit, which have duly been explained in para 11 of the affidavit to bail application. It has further been submitted that the applicant is languishing in jail since 16.08.2022 and in case applicant is released on bail he will not misuse the liberty of bail and will cooperate in trail.
