Learned counsel for the applicant submits that the applicant is innocent and has falsely been implicated in the aforesaid crime. The applicant has not committed any offence as alleged in the FIR. Learned counsel further submits that the FIR was lodged against unknown persons for committing murder of the husband of the first informant. The co-accused Phoolmati, wife of the deceased informed the police regarding the missing of her husband on 27.10.2021 and on that basis, the FIR was lodged. During course of investigation, the first informant, the wife of the deceased herself was made an accused in the case by the police. On 28.10.2021, the dead body of deceased was identified by the mother and the brother of the deceased as Devraj Pasi. It is further submitted that during inquest proceedings, five witnesses namely, Ramraj Pasi, Devdat Pasi, Banwari Pasi, Vansh Gopal and Prithvi Pasi were present. But till completion of inquest report, the name of the applicant was not disclosed by these witnesses. Later on, the name of the applicant surfaced on the statement of Jagpatiya, Devedatt, Ramraj, Banwari and Ramchandra. These are the witnesses of inquest who kept mum till completion of inquest report. But in the statement of these witnesses they stated that the applicant was seen with the co-accused Rajendra who came to meet with co-accused Phoolmati, while the applicant was walking outside. Thus, the name of the applicant was disclosed as a last seen evidence. Apart from this, false recovery of cloth was made from the possession of the applicant on his pointing out. Only due to being a friend of the main co-accused Rajendra, the applicant was falsely roped in the case. Thus, no disclosed offence is made out against the applicant.
