Per contra, learned A.G.A. vehemently opposing the bail application has contended that the accused was working as Incharge / Secretary at Paddy Purchase Centre i.e. Barwa Sadhan Sahkari Samiti Limited and a total of 11685.08 quintal paddy (valuing Rs.22669055.20) was purchased on the aforesaid Purchase Centre, but the Rice Mills were delivered 5330.20 quintal paddy only and the rest 6354.88 quintal paddy (valuing Rs.12328467.20) were sold anywhere else instead of delivering it to the Rice Mills. Besides it, forged online challans were obtained and a false and forged paddy delivery has been shown at which the Rice Mills have made complaints. By the aforesaid forged act, the accused, who is responsible for the total affairs as a public servant, has made criminal breach of trust and misappropriated pubic money valuing Rs.12328467.20. The Executive Inquiry Committee made for the said purpose has found the accused guilty after thorough inquiry and subsequently F.I.R. was lodged against the accused. During the course of investigation, sufficient evidence was collected against the accused and charge-sheet was submitted to the Court concerned. It has been submitted that since a huge public money has been misappropriated by the accused, who was a public servant, his offence is very grave and serious in nature and the prayer for rejection of the bail application has been made.
