It is submitted by the learned counsel for the applicant that applicant has been falsely implicated in the present case and he has not committed the alleged offence. It is further submitted that applicant is not named in the F.I.R. The name of the applicant surfaced in the statement of informant/injured. No specific role has been assigned to the applicant, specially regarding firing at injured. Admittedly, there was a dispute regarding money transaction between the sons of the injured and other accused. It is next submitted that similarly placed co-accused Rishikesh @ Rikku Yadav has been granted bail by another Bench of this Court vide order dated 18.08.2022 passed in Criminal Misc. Bail Application No. 30196 of 2022, therefore, applicant is also entitled for bail. Bail order dated 18.08.2022 has been produced in the Court which is taken on record. It is further submitted that there is no criminal history of the applicant. It is also submitted that there is no possibility of applicant either fleeing away from the judicial process or tampering with the witnesses. Applicant is in jail since 06.05.2022, undertakes that he will not misuse the liberty during bail, if granted.
