The instant bail application has been filed on behalf of the applicant with a prayer to admit him on bail in Case Crime No. 118/2022, under Sections 143, 144, 145, 147, 148, 149, 153A, 153B, 295A, 201, 511, 307, 332, 333, 353, 395, 435, 436, 427, 504, 505(2), 506, 120B IPC and sections 4/5 Explosives Substance Act and 7 CLA Act and 83 Juvenile Justice Board Act and 3/4 Prevention of Public Property Damages Act, Police Station- Khuldabad, District - Allahabad.

Heard learned counsel for the applicant, learned A,G.A. for the State and also perused the record.

Learned counsel for the applicant submits that the applicant is absolutely innocent and has falsely been implicated in the present crime as general role has been assigned to all the accused persons. It is further submitted that no evidence has been collected by the IO for section 436 IPC and no building, place of worship etc. was destroyed by fire. He further submits that no statement and name was entered in the case-diary as to whose weapons were plunder or attempted to be plunder. He next submits that all the injuries are simple and caused by hard and blunt objects. He pointed out that co-accused Mohd. Qadir has already been granted bail by the co-ordinate Bench of this Court vide order dated 20.9.2022 passed in Criminal Misc. Bail Application No. 40144 of 2022. It is lastly submitted that the applicant has no criminal history to his credit and he is in jail since 11.6.2022. There are scanty chances of his fleeing away from the judicial process and tampering the prosecution evidence.

Learned A.G.A. has, however, opposed the prayer for grant of bail.

Considering the facts and circumstances of the case, perusing the record and also considering the nature of allegations, arguments advanced by the learned counsel for the parties and without expressing any opinion on the merit of the case, I find it

to be a fit case for granting bail.

Let the applicant Imran Ahmad involved in aforesaid crime be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :-

The applicant shall not tamper with the prosecution evidence by intimidating/ pressurizing the witnesses, during the investigation or trial.

¶13

The applicant shall cooperate in the trial sincerely without seeking any adjournment.

¶14

The applicant shall not indulge in any criminal activity or commission of any crime after being released on bail.

¶15

In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicant and sureties be verified by the court concerned before the bonds are accepted.
