The submission of the learned counsel for the applicant is that the applicant is innocent and has been falsely implicated in the present case. As per FIR, on 01-02-2022, two unauthorized withdrawals were made from the A.T.M. cards of the informant, one of Rs. 500/- and the other of Rs. 15,000/-. It is submitted that on the basis of an information received from a mukhbirthe, concerned police have arrested 5 persons and 108 A.T.M. cards and Rs. 64,000/- is said to have been recovered from them. It is also submitted that he has no previous criminal history and after his arrest, the police has implicated him in 7 cases of similar nature. The details whereof have been mentioned in the supplementary affidavit filed on behalf of the applicant which is taken on record. It is further submitted that the co-accused Monu Kumar and Anil Kumar identically circumstanced as the applicant have been enlarged on bail by a co-ordinate Bench of this Court vide order dated 18-10-2022 and 3.11.2022 passed in Criminal Misc. Bail Application No. 34315 of 2022 and 37337 of 2022 respectively entitling the applicant to be released on bail on the ground of parity. It is in the last submitted that the applicant is in jail since 10.05.2022 and in case the applicant is released on bail, he will not misuse the liberty of bail.
