Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
The instant bail application has been filed on behalf of the applicant Muzammil with a prayer to release him on bail in Case Crime No.70 of 2022, under Section 3 (1) U.P. Gangsters and Anti Social Activities (Prevention) Act 1986, P.S. Colonelganj, District Kanpur Nagar, during pendency of the trial.
It is argued by the learned counsel for the applicant that according to the gang chart the applicant is said to have been involved in three criminal cases in which he has already been enlarged on bail by coordinate Bench of this court in Criminal Misc.Bail Application Nos.39083 of 2021, 43517 of 2021 & 45396 of 2021 vide orders dated 15.12.2021, 27.11.2021 and 28.01.2022 (Annexure 2 to the bail application). He next argued that co-accused and gang leader Atiqurrahman has been granted bail by coordinate Bench of this Court in Criminal Misc.Bail Application No.24512 of 2022 vide order dated 04.07.2022. Applicant has no criminal history except cases shown in the gang chart. There is no prospect of trial of the present case being concluded in near future due to heavy dockets. The applicant is languishing in jail since 16.03.2021 and in case he is enlarged on bail he will not misuse the liberty of bail.
