It is submitted by learned counsel for the applicant that he is innocent and has been falsely implicated in the present case for committing murder of the deceased, who was her husband, with the help of other co-accused persons including her daughter and one other Amit Katheriya. Further submitted that the dead body of the deceased was found in a nala on 16.03.2022 regarding which FIR was lodged by daughter of deceased, namely, Shivangi against unknown persons. During investigation it was found that Shivangi was in relation with co-accused Amit Katheriya and that was the reason, she committed murder of the deceased (her father) with the help of Amit Katheriya and this applicant. It is further submitted that co-accused Shivangi has already been granted bail by coordinate Bench of this Court vide order dated 16.08.2022 passed in Crl. Misc. Bail Application No. 33191 of 2022. The case of the applicant is on similar footing, therefore, she is also entitled to be released on bail. The applicant is in jail Since 23.03.2022 having no any criminal antecedent. In case she is released on bail, she will not misuse the liberty of bail and will cooperate in trial.
