It is argued by the learned counsel for the applicant that the daughter of the first informant was missing. When the first informant along with his wife went to the house of the present applicant, he was found at his house. As per the statement of the victim under section 161 Cr.P.C., she was recovered by the police at Gurgaon. She has stated in her statement under section 161 Cr.P.C. that she was lifted by three unknown persons by gagging her mouth in a four wheeler. She was made unconscious. Next day when she gained her conscious, she found that her hands and feet were tied up. She was beaten and was raped. The accused persons were talking to Shivam Pandey and Shivam Pandey was updating them that the family members of the victim had lodged the first information report. The girl is said to have escaped from that place and reached at the railway station from where she is rescued by the police. As per the statement of girl under section 164 Cr.P.C. appended at page '54' of the paper book, Shivam Pandey came to her house along with other persons. When the victim came to bolt the door of her house, she was caught by Shubham Pandey who made her unconscious by putting cloth on her face. When she gained her conscious, she found herself in a room. Shubham Pandey was present there. Two other persons present there committed rape upon her. Thus, it is argued that there are contradictions in the statements of victim. The name of the applicant is not mentioned among the boys who kidnapped the girl from her house and who raped her or otherwise, committed atrocities upon her. The applicant is languishing in jail from 18.12.2021, so the prayer for bail is made.
