Learned counsel for the first informant has not appeared at the time of argument.
The accused applicant, Arjun, is involved in Case Crime No. 252 of 2019, under Section 354ka I.P.C., 7/8 POCSO Act and 67A of I.T. Act, registered at Police Station Taryasujan District Kushinagar.
It is argued by the learned counsel for the applicant that the first information report is delayed. In the statement under Section 161 Cr.P.C. the main role is assigned to the co-accused and not to the present accused. The accused is in judicial custody since 08.09.2021, hence the prayer for bail is made.
Learned A.G.A. has submitted that as per statement under Section 164 Cr.P.C. the main role is assigned to the present accused.
