Learned counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in the present crime. It is submitted that according to the police against the loot of Rs. 11,81,130/- a sum of Rs. 50,000/- was recovered from the possession of the applicant. It is further stated that the applicant has no connection with the alleged incident. It is submitted that as per FIR as well as statement recorded by the Investigating Officer no specific role has been assigned against the applicant. It is further stated that the applicant has no previous criminal history. It is stated that after taking note of entire facts and circumstances of the case, co-accused, namely, Robin Jaat, has already been enlarged on bail by this Court vide order dated 22.9.2022 passed in Criminal Misc. Bail Application No. 28190 of 2022. Accordingly, the applicant is also entitled for bail on the ground of parity. It is also submitted that there is no apprehension that after being released on bail, he may flee from the course of law or may, otherwise, misuse the liberty of bail and the applicant is in jail since 6.4.2022 and the possibility of conclusion of trial in near future is very bleak.
