Heard learned counsel for the applicant as well as learned A.G.A. for the State and perused the record.

It is submitted that in this case applicant has been falsely implicated for causing murder of the deceased Raju with three other co-accused persons namely Hori, Gendan Lal & Ram Singh out of which co-accused Ram Singh has already been enlarged on bail by co-ordinate Bench of this Court. Further submitted that as per the statement of the informant co-accused Pappu made fire on the deceased as a result he died. Likewise eye-witness Reshu has also assigned the role of firing to coaccused Pappu. In post-mortem report only single injury was found on the person of the deceased. It is also submitted that the name of this applicant was exonerated during investigation and final report was submitted but learned court concerned took cognizance of the offence against this applicant also. There is no criminal antecedent against the applicant and he is in jail since 09.05.2022, therefore, requested for bail. In case he is released on bail, he will not misuse the liberty of bail and will co-operate in trial.
