Learned counsel for the applicant has submitted that the applicant has been falsely implicated in the present case and as per contents of FIR version on 27th April, 2018 in the night at about 10.00 pm. applicant and co-accused Seraj @ Sonu enticed away the victim aged about 15 years and committed misdeed. On the next day in the morning informant received information from police station Sidhari that both have been apprehended by the police along with victim, on information informant along with people reached the police station, it was stated in the police station that his daughter is minor and take away her to his house in case of necessity will be called. After the statement of the police, informant took away her on the belief that legal action would have been taken, because he had informed in the police station Sidhari about the matter, when he went to the police station for obtaining the copy of the report then it was told that the incident is related to jurisdiction of the police station Gambheerpur, therefore report cannot be lodged here on which he became shocked then, regarding the whole incident information was given. He submits that incident has occurred on 27th April, 2018 and FIR has been lodged by the delay of 9 days i.e. 7th May, 2018, which creates doubt on investigation as well as in the matter. He further submits that in a pre-plan manner FIR has been lodged to falsely implicate the applicant. It is submitted by learned counsel for the applicant that there is no criminal history against the applicant. It is further submitted that similarly placed co-accused, Seraj @ Sonu has already been enlarged on bail by this Court by order dated 02.06.2022
