Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case. He further submits that First Information Report was lodged with delay without any plausible explanation. Learned counsel for the applicant submits that the marriage of the applicant was solemnized with deceased Seema on 28.05.2015. It is further argued by the learned counsel for the applicant that allegations levelled against the applicant and entire family member of committing murder of the deceased is false and baseless as it was found in the post mortem report that cause of death was hanging. It is also submitted that there are general allegations of demand of dowry against the applicant and other accused persons. There is no specific role assigned to the applicant. It is further argued that the deceased wanted to live separately from her in-laws and since the applicant did not fulfil her desire, therefore, she committed suicide. It is also argued that prosecution witnesses namely Vinod Kumar Sharma (first informant) was examined as P.W.1, P.W.2 Vijay Kumar Sharma, P.W.3 Sushila Sharma (father and mother of the deceased) and P.W.4 Shatrudhan Sharma (brother of deceased) did not support the prosecution story and turned hostile. Learned counsel for the applicant submits that co-accused Akhilesh Dever of deceased has already been enlarged on bail by another co-ordinate Bench of this court, vide orders dated 07.12.2020, passed in Criminal Misc. Bail Application No. 43679 of 2020.
