Learned counsel for the applicant submits that as per FIR version a loot was committed on 24th March, 2022 by 3 miscreants and after 3 days of the incident 4 co-accused persons were arrested by the police namely Amit Kumar @ Mannu, Pooran Lal, Suraj Pal and applicant and Vimal succeeded in fleeing away. The co-accused Amit Kumar @ Mannu, Pooran Lal have been granted bail by co-ordinate Bench of this Court vide orders dated 16.06.2022 and 01.06.2022 in Criminal Misc. Bail Application Nos. 23909 of 2022 and 21998 of 2022, therefore, the applicant is also entitled for bail on the ground of parity. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that applicant has no previous criminal history, after the present case a Case Crime No. 150 of 2022 has been registered against him in which he has been enlarged on bail and he is languishing in jail since 24.03.2022.
