Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material available on record.
The present bail application has been filed by the applicant with a prayer to enlarge him on bail in Case Crime No.98 of 2022, under Sections 147, 148, 149, 323, 308, 504 I.P.C., Police Station Civil Line, District Budaun.
Learned counsel for the applicant submits that general allegation for causing injury to the injured by lathi and danda has been levelled against the applicant and seven others. He next submits that as per injury report Pravendra has received two injuries and Ram Niwas has received a grievous injury on his head and he was unconscious for four days and doctor has opined that injury of Ram Niwas was fatal. He further submits that applicant has no criminal history. He next submits that it is not clear who is author of the fatal injury. He next submits that applicant has been falsely implicated in the case. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that the applicant is languishing in jail since 9.2.2022.
