Heard learned counsel for the applicant and learned A.G.A. for the State respondent.

It is contended that the applicant has been falsely implicated in the instant case. The applicant was not named in the first information report. The alleged motorcycle no. UP 80 FH 5045 has been recovered from the co-accused Dalbeer Singh, who has been granted bail by this Court vide order dated 15.12.2021 in criminal misc. bail application no. 44508 of 2021, copy of which has been produced, which is taken on record. The motorcycle, which has been recovered from the applicant, is not connected with the present offence. Prior to the instant case, the applicant does not have any criminal history and after his arrest, he has been implicated in other cases. The applicant is in jail since 11.06.2021 and if he is released on bail, he will not misuse the liberty of bail.

Learned A.G.A. has opposed the prayer for bail but could not satisfactorily dispute the aforesaid submission from the record.

Perused the first information report as well as averments made in the application.

Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, let the applicant Monu alias Monendra involved in case crime no. 219 of 2021 under Section 395, 412 IPC police station Etmadpur district Agra be released on bail on his furnishing a personal bond and two local sureties each in the like amount to the satisfaction of court concerned subject to the conditions that he:

shall appear on the date fixed by the trial court;

shall not tamper with the prosecution evidence;

¶12

shall not pressurize the prosecution witnesses.

In case of breach of any of the above conditions, the prosecution shall be at liberty to move bail cancellation application before this Court.
