Heard Sri Vikas Tripathi, learned counsel for the applicant and Sri Jitendra Kumar Jaiswal, learned AGA for the State.

It is contended that the applicant has been falsely implicated in the instant case. False recovery of beef (cow meat) has been shown from the possession of the applicant. There is no independent witness to the recovery. There is no FSL report to establish that beef is recovered. The applicant is in jail since 04.11.2021 having no criminal history to his credit and in case he is enlarged on bail, he will not misuse the said liberty.

Learned AGA has opposed the prayer for bail but could not satisfactorily dispute the aforesaid submissions from the record.

Perused the first information report as well as the averments made in the application.

Considering the facts and circumstances of the case and also perusing the material on record, without expressing any opinion on the merit of the case, let the applicant Haroon involved in Case Crime No. 400 of 2021, under Section 3/5/8 Prevention of Cow Slaughter Act, Police Station Simbhawali, District Hapur be released on bail on his furnishing a personal bond and two local sureties each in the like amount to the satisfaction of the court concerned on the following conditions that:

(i) the applicant shall not tamper with the prosecution evidence;

¶9

(ii) the applicant shall not pressurize the prosecution witnesses;

¶10

(iii) the applicant shall appear on each and every date fixed by the trial court.

In case of breach of any of the above conditions, the prosecution shall be at liberty to move bail cancellation application before this Court.
