Heard Sri Diwakar Tiwari, the learned counsel for the applicant, Sri Dinesh Kumar Srivastava, the learned Additional Government Advocate and perused the record.
The instant application has been filed seeking grant of bail to the applicant in Case Crime No. 714 of 2021, under Sections 420, 467, 468, 471, 120-B IPC, Section 60D/72A of Information Technology (Amendment) Act, 2008 and Section 5/10 of the Uttar Pradesh Public Examination Act, Police Station Banna Devi, District Aligarh during the pendency of the trial in the Court below.
The aforesaid F.I.R. has been lodged by the Inspector, STF Field Unit against 11 named persons including the applicant, on the basis of confessional statement made by a co-accused.
It has been stated in the affidavit filed in support of the bail application that the applicant is a student of M.A. and he has no criminal history; that nothing has been recovered from the applicant and that he has been falsely implicated in this case. It has further been stated that the case set up against the applicant is similar to that set up against other co-accused persons, namely, Himanshu Kumar, Pradeep, Yogendra Kumar and Rajveer Singh, all of whom have already been released on bail by means of orders dated 22.02.2022, 07.04.2022, 25.03.2022 and 23.03.2022 passed by this Court in Criminal Misc. Bail Application Nos. 4567 of 2022, 7597 of 2022, 8525 of 2022 and 6290 of 2022 respectively.
