Heard Sri Chandra Prakash Singh, the learned counsel for the applicant, Sri Arun Kumar Pandey, the learned Additional Government Advocate and perused the record.

The instant application has been filed seeking grant of bail to the applicant in Case Crime No. 309 of 2021, under Sections 498-A, 323, 504, 307 IPC and Section 3/4 Dowry Prohibition Act, Police Station Kakod, District Bulandsahar during the pendency of the trial in the Court below.

The aforesaid case has been registered on the basis of F.I.R. lodged on the basis of information given by the applicant's wife Jyoti @ Gyatri on 19-06-2021 alleging that her husband - applicant and his family members had beaten her for demand of dowry.

In the affidavit filed in support of the bail application, it has been stated that the informant has lodged a false report only to harass the applicant and his family members; that the F.I.R. regarding the incident alleged to have been taken place on 27.05.2021, has been lodged on 19.06.2021 and there is no explanation for the delay and that the incident is alleged to have been taken at a public place but there is no independent witness of the incident.

The learned counsel for the applicant has submitted that there are only general allegations and there is no specific allegation against the applicant. One of the two co-accused persons, namely, Sushil Singh - the applicant's father, has already been granted bail by means of an order dated 16.03.2022 passed by this Court in Criminal Misc. Bail Application No. 9363 of 2022.

Per contra, the learned Additional Government Advocate has opposed the prayer for grant of bail but he could not dispute the aforesaid aspect of the matter.

Keeping in view the aforesaid facts and circumstances of the

case, I find it to be a fit case for grant of bail to the applicant in the aforesaid case.

In the light of preceding discussion and without making any observation on the merit of the case, the instant bail application is allowed .

Let the applicant Tannu @ Tej Singh be released on bail in Case Crime No. 309 of 2021, under Sections 498-A, 323, 504, 307 IPC and Section 3/4 Dowry Prohibition Act on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court below, subject to the following conditions:-

(i) The applicant will not tamper with the evidence during the trial.

(ii) The applicant will not influence any witness.

¶17

(iii) The applicant will appear before the trial court on the date fixed, unless personal presence is exempted.

¶18

(iv) The applicant shall not directly or indirectly make inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court to any police officer or tamper with the evidence.

In case of breach of any of the above condition, the prosecution shall be at liberty to move an application before this Court for cancellation of the bail.
