Learned counsel for the applicant has argued that a first information report has been lodged by the complainant being Smt. Ramawati wife of Tribuvan Prasad before Police StationKolhui, District-Maharajganj being FIR No.0134 of 2020 on 24.5.2020 at 10.30 hours under Sections 147, 148, 336, 323, 325, 308, 504, 506 I.P.C. read with Section 3(1) Dha SC/ST and Section 3 of the Epidemic Act, 1897 against the applicant and 9 others as well as the accused family with an allegation that between house and the complainant of the Pradhan being Ram Keval, who is the accused number 1 in the FIR, there is a drain from whether the drainage water flows, however, Ram Keval has encroached the said land and included the said land and is using the said land for his own purpose and on the unlucky day i.e. on 22.6.2020 certain water started flowing from there then the accused administered beating upon the complainant on account whereof the complainant as well as three others sustained injuries. He has further argued that even from the allegation contained in the FIR, no specific role has been assigned. He has also referred to the statements of the injured so as to contend that even in the statements so made by them only general role has been assigned and no specific role has been assigned to the applicant.
