It has been argued by learned counsel for the applicant that applicant is innocent and he has been falsely implicated in the present case. The complainant was already married lady as per Muslim religion but thereafter she has started living with brother of applicant, namely, Suneel in relationship. It was stated that some dispute has taken place between complainant and her alleged husband Suneel and in this connection applicant was illegally apprehended by the police on 24.02.2022. In this connection the brother of applicant has made a complaint on 25.02.2022 to the I.G. Agra Zone, alleging that In-charge of Police Station Etmaddaula is demanding bribe of Rs. 3,50,000/-. After that the first information report of this case was lodged on 28.02.2022. Learned counsel has pointed out that in the typed complaint, which was made by the complainant/prosecutrix to S.S.P. Agra, there were no allegations of rape against the applicant and the version regarding rape by applicant was added later on by hand in the said typed complaint. Learned counsel submitted that in fact, as the brother of applicant has made a complaint against the Incharge of police station Etamaddaula, after that the allegation of rape against the applicant was inserted in the complaint, which was filed by the complainant.
