This is second bail application.
The present application has been moved seeking bail in Case Crime no. 57 of 2020, under Sections 302, 34 IPC, P.S. Firozabad North, District Firozabad, with the prayer that in the event of arrest, applicant may be released on bail.
It has been argued by learned counsel for the applicant that the applicant is innocent and he has been falsely implicated in the present case. The first bail application of the applicant was rejected by this Court vide order dated 08.12.2020 in Criminal Misc. Bail Application No. 37501 of 2020 but at that time the statements of witnesses, recorded under Section 161 Cr.P.C., were not considered by this Court. Referring the statements of witnesses, recorded under Section 161 Cr.P.C., it has been submitted that role of all the four accused persons, including the applicant, has been shown of firing at the deceased but deceased has sustained only one injury.
