Learned Counsel for the applicant has submitted that applicant is innocent and has been falsely implicated in the present case. First information report has been lodged against four unknown persons with the allegations that on 26.08.2021 at about 06:15 a.m. an unknown women knocked the door of of the complainant with a request that she is having stomach ache and as such she may be permitted to use toilet for nature call, when the mother of the informant resisted the same, she called other three persons and they forcibly entered the house and used physical force and took away jewellery, two mobile phones and Rs.50,000/- cash. It is submitted that nothing has been recovered form the possession of the applicant. Name of the applicant surfaced in the statement of the co-accused Preeti Sharma. It is next submitted that co-accused Rajkeen, Mohammad Sabir, Areeb, Suman, Nagma, Bilal Husain and Smt. Preeti have been enlarged on bail by the co-ordinate Benches of this Court in Criminal Misc. Bail Application Nos.47975 of 2021, 53668 of 2021, 53980 of 2021, 49604 of 2021, 45287 of 2021, 11628 of 2022 and 10428 of 2022 vide orders dated 01.12.2021, 20.12.2021, 22.12.2021, 09.02.2022, 25.03.2022 and 30.03.2022, copies of the bail orders have been taken on record. Criminal history of the applicant has been explained in paragraph 14 of the affidavit which is annexed as Annexure No.3 to the affidavit. In case, he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial by all means.
