Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case with a view to cause unnecessary harassment and to victimize him. It is further submitted that the first information report has been lodged by private party Om Prakash by way of an application under Section 156(3) Cr.P.C., stating that the applicant and other four named co-accused persons have got prepared fake X-ray report and C.T. Scan report from the District Hospital, Agra. It is further submitted that X-ray report as well as C.T. Scan report have been prepared by the doctors of District Hospital, Agra. It is next contended that the applicant has not prepared the aforesaid documents. The applicant has no concern with regard to the preparation of the aforesaid X-ray report and C.T. Scan report. FIR has been lodged after three months from the date of the alleged incident, without any plausible explanation. There is no criminal history against the applicant. It is further stated that co-accused person, namely, Smt. Meena and Natthi Lal, have already been granted anticipatory bail by the co-ordinate Bench of this Court vide order dated 14.02.2022 passed in Criminal Misc. Anticipatory Bail Application No.990 of 2022. The case of the applicant is identical to the case of the co-accused person. The applicant is languishing in jail since 08.01.2022. In case, the applicant is released on bail, he will not misuse the liberty of bail.
